In accordance with the provisions set forth in articles 8, 13, 15, 16, 17, 36 and other applicable provisions of the Federal Data Protection Law on Personal Data Held by Private Parties (Ley Federal de Protección de Datos Personales en Posesión de los Particulares in Spanish); Articles 24, 25, 26, 27, 28, 29 and other applicable regulations of the law and its guidelines (hereinafter “The Law”). We make this privacy notice available to you, in order to communicate how  the data that you provide to us will be treated, as well as the means you have to access, rectify, cancel or oppose the aforementioned treatment:

 

I. IDENTITY AND ADDRESS OF THE RESPONSIBLE PARTY:

PROMOTORA DE VIVIENDAS INTEGRALES, S.A. de C.V., located at Avenida Vía Real Manzana 16 Lot 1 Local 1, Fraccionamiento Real del Sol, Municipality of Tecámac, State of Mexico, C.P. 55770, will be the company responsible for collecting, using and protecting your personal data, including data that isprovided to any of our controlling companies, affiliates, subsidiaries, co-owned and / or commercial partners (jointly referred to as INMOBILIARIA VINTE).

 

II. PURPOSES OF THE DATA USAGE:

The personal data that you provide to us, either in person at our points of sale, in our customer registration kiosks or public housing events, as well as data you provide through digital and telecommunications platforms, such as our websites, social networks, applications (“apps”) or via telephone, are treated as strictly confidential, so, by providing them, INMOBILIARIA VINTE guarantees that they will be used exclusively for the following purposes:

 

PRIMARY PURPOSES:

The personal data we collect from you, will be used for the following purposes that are necessary for the service you request:

A.- Identify you as a customer or interested in our products and / or services, and with it, generate a database;

B.- Contact you to follow up on the purchase of our properties;

C.- Offer information and publicity about our related products and services and to communicate about changes to them;

D.- Assist in credit management;

E.- Internal administrative processes of file integration, returns, processing of applications, collection, clarifications, credit investigation;

F.- Follow up on complaints and clarifications;

G.- Preparation of documents, contracts, agreements, invoices, receipts, and documentation related to the acquisition of any of our properties;

H.- Formalization of sales transactions;

 

SECONDARY PURPOSES:

In addition, we will use your personal information for the following purposes that are not necessary for the requested service, but which allow and help us to provide you with better care:

I.- Quality assessment and/or after-sales follow-up;

J.- Comply with the terms and conditions that we have established with you as a customer;

K.- Inform you of our new developments and promotions;

L.- Formation of civil associations and boards of directors in housing developments;

M.- Community integration and registration of clients in sports, recreational and /or cultural spaces organized by INMOBILIARIA VINTE in housing developments.

 

III. MECHANISMS FOR THE HOLDER TO EXPRESS HIS/HER REFUSAL FOR SECONDARY OR ACCESSORY DATA USAGE

In relation to Secondary Purposes, you have a period of five working days to assert your right to revoke or express your refusal for the processing of your Personal Data, and thus the use and disclosure of your Personal Data by INMOBILIARIA VINTE is limited.

For the above, you must address your request in writing to our personal data protection department located at Avenida Vía Real Manzana 16 Lot 1 Local 1, Fraction Real del Sol, Municipio de Tecámac, Estado de México, C.P. 55770, or send an email to privacidad@54.160.93.124, in which you include the following:

1.- Your name and surname/the name and surname of anyone who represents you;

2.- The address to send notifications to, or, if you wish, an email;

3.- A copy of your official photo ID of you and/or that of the person representing you;

4.- If you make the request through a representative, a document in which you prove your representation, this may be via a notarized document, or a letter of power of attorney signed before two witnesses;

5.- A clear and accurate description of your opposition to the transfer of your Personal Data in connection with Secondary Purposes;

6.- If possible, indicate the name and location of the file or data record, as well as the area where they are located;

7.- The Application signed by you and/or your representative.

Upon the submission of the request, you will receive , which will be sent to you in the same way in which it was submitted.

In the case that we do not obtain your express opposition within five days, your personal data will be transferred in the manner and in accordance with the terms described, and we will understand that you have granted tacit consent.

In the event that the request does not contain the required information or does not indicate the channel to contact you, INMOBILIARIA VINTE will freely establish the method it deems relevant to send you information about your request.

The deadline to respond to your request will be five calendar days, where you will be informed if your request will proceed or not.

The refusal to use your personal data for secondary purposes cannot be a reason for us not to contact you or to deny you the services and products you request.

 

IV. PROCESSED PERSONAL DATA

a. Your identification data: Full name, date and place of birth, address, home phone number, cell phone number, marital status, place of work, number of children, age of your children; gender, work address, position, seniority in the company, e-mail, professional ID, driver’s license, marriage certificate, birth certificate, INE credential number, passport copy, CURP, RFC, proof of address, matrimonial regime, schooling, family reference, personal reference, image in any format and its signature, copy of the proof of fiscal situation.

b. Identification data of your spouse: Full name, date of birth, address, INE credential number, CURP, position, seniority in the company, address where he/she works, work phone number, image in any format.

c. Identification data of the co-accredited: Full name, image in any format, place of work, date of birth, work address, position, work phone number, seniority at work, copy of the proof of tax status.

d. The following property data will also be required: Income from your current and previous job, copy of the AFORE account statement, Social Security Number (NSS), co-creditor’s income, paycheck, INFONAVIT or bank prequalification, spouse’s NSS, your spouse’s salary status and salary account, copy of the co-creditor’s AFORE account statement.

 

V. EXPRESS SIGNALING OF SENSITIVE PERSONAL DATA THAT ISPROCESSED

Due to the nature of the products and / or services that INMOBILIARIA VINTE sells, NO sensitive personal data will be collected, such as those that may reveal aspects such as racial or ethnic origin, present and future health status, genetic information, religious beliefs, philosophy and morals, union affiliation, political opinions, sexual orientation.

 

VI. TRANSFER OF PERSONAL DATA

We inform you that your personal data contained in our databases can be transferred to any of the controlling companies, subsidiaries, co-owners and / or subsidiaries of INMOBILIARIA VINTE as well as to commercial partners, to their third party service providers, to credit institutions for housing, notaries, valuers, civil associations or boards that are formed in housing developments, property managers and property regimes in condominiums, administrators or service providers of sports, recreational and / or cultural spaces, and even to third parties or legal entities that have a strict relationship with the real estate sector.

The transfer of your personal data will be made solely and exclusively for purposes related to the legal relationship that is created between you and INMOBILIARIA VINTE. Therefore, the transfer of your personal data to the controlling companies, affiliates, co-owners and/or subsidiaries of INMOBILIARIA VINTE, as well as commercial partners, will have the responsibility of contacting you to follow up on the purchase of our properties, offer you information and advertising about our related products and services and to inform you about changes to them, as well as to assist you in credit management. In the event that the transfer of data is made to third-party service providers, to housing credit institutions, notaries, valuers, to civil associations or boards that are formed in housing developments, real estate administrators and property regimes in condominiums, to the administrators or service providers of sports, recreational and/or cultural spaces, and even to third-party individuals or legal entities that have a close relationship with the real estate sector, it will be in order to assist you in the processing of your mortgage credit, to carry out the deed processes for the housing that you acquire, to offer furniture for the house and to integrate you in the civil associations, board and clubhouses that are formed in the housing developments.

 

VII. CLAUSE INDICATING WHETHER OR NOT THE HOLDER ACCEPTS THE TRANSFER OF DATA IF/WHEN NEEDED

In terms of what is decreed by “The Law”, you may express your opposition to the transfer of your personal data, for which, you must direct your request in writing to our personal data protection department located on Avenida Vía Real Manzana 16 Lot 1 Local 1, Fraccionamiento Real del Sol, Municipio de Tecámac, Estado de México, CP 55770. VIII. MEANS AND PROCEDURE TO EXERCISE ARCO RIGHTS

All your personal data is treated in accordance with the provisions of applicable legislation in force in the country, so we inform you that you have at all times the right to access, rectify, cancel or oppose (ARCO RIGHTS) the treatment we give to your personal data. Therefore it is necessary that you direct your request in writing to our personal data protection department located at Avenida Vía Real Manzana 16 Lot 1 Local 1, Fractionation Real del Sol, Municipio de Tecámac, Estado de Mexico, CP 55770. 1.- Your name and surname/the name and surname of anyone who represents you;

2.- The address to send notifications to, or, if you wish, an email;

3.- A simple copy of your official photo ID of you and/or that of the person representing you;

4.- If you make the request through a representative, a document in which you prove your representation, this may be via a notarized document, or a letter of power of attorney signed before two witnesses;

5.- A clear and accurate description of the Personal Data for which you seek to exercise some of the ARCO Rights;

6.- If possible, indicate the name and location of the file or data record, as well as the area where they are located;

7.- The application signed by you and/or your representative.

In addition to the aforementioned requirements, you must include in the application the following information, as appropriate:

    • Right of ACCESS: Method in which you prefer access to be provided
    • Right of RECTIFICATION: Modifications requested and, where appropriate, the documents and/or evidence needed to support these changes.
    • CANCELLATION right: Reasons behind the request to delete personal data.
    • OPPOSITION Right: Situation that leads to the request for the processing of personal data be concluded, as well as the damage that would be caused by the continuation or indication of the specific purposes for which you request that the treatment be concluded.

Upon the submission of the request, you will receive confirmation of receipt, which will be sent to you in the same way in which it was submitted.

Upon receipt of the ARCO application, INMOBILIARIA VINTE’s Personal Data Department, will verify if it meets all the requirements previously described, if not, it will contact the Holder by email or in person or telephone and will require them to correct the deficiencies in the next 10 (ten) business days from receipt of the request. In the event that it is not corrected within 10 (ten) business days, the application will be considered as not submitted.

In the event that the request does not contain the channel by which to contact you, INMOBILIARIA VINTE will freely establish the method it deems pertinent to send you information about your request.

The deadline to meet your request will be 20 calendar days, in accordance with the provisions of article 32 of “The Law”, where you will be informed whether your request will proceed or not..

As for the personal data of a deceased person, only the person who proves to have a legal interest may exercise ARCO rights. Those who can make this claim are, but not limited to: the executor, the heirs, the legatees or any person who has been previously designated by the holder to exercise the ARCO rights on their behalf.

The aforementioned will be identified by a simple copy of the following documents:

  • Official identification of the person to whom the personal data belonged.
  • Corresponding death certificate.
  • Document(s) proving the legal interest of the person submitting the application:
    • Document where the owner of the personal data has faithfully expressed his willingness for this person to exercise the ARCO rights in relation to his personal data.
    • Judicial mandate that exists for that purpose.
    • Official identification of the person submitting the application.

 

INMOBILIARIA VINTE is not obliged to remove personal data when:

  • It refers to parts of a contract and is necessary for its development and compliance.
  • Processing of this data is a legal requirement.
  • It obstructs judicial or administrative proceedings.
  • It is necessary to protect the legal interests of the Holder.
  • It is necessary to comply with a legal obligation.

 

IX. MECHANISMS AND PROCEDURES IN WHICH THE HOLDER MAY REVOKE CONSENT TO THE PROCESSING OF PERSONAL DATA

You have the right to revoke your consent for the processing of your personal data at any time, according to the terms established in this Privacy Notice. In this case, you should direct your request in writing to our personal data protection department located on Avenida Vía Real Manzana 16 Lot 1 Local 1, Fraccionamiento Real del Sol, Municipio de Tecámac, Estado de Mexico, CP 55770. 5.- A clear and accurate description of your opposition to the processing of your Personal Data;

6.- If possible, indicate the name and location of the file or data record, as well as the area where they are located;

7.- The application signed by you and/or your representative.

Upon the request submitted, you will get a receipt acknowledgment, which will be transmitted to you in the same way in which it was submitted. Upon the submission of the request, you will receive confirmation of receipt, which will be sent to you in the same way in which it was submitted.

Until we receive  an express revocation request to treat your personal data in the manner and terms described, we will continue to use it in the purposes for which it was obtained.

In the event that the request does not contain the required information or does not indicate the conduit for contacting you, INMOBILIARIA VINTE will freely establish the channel it deems appropriate to send information about your request. In the event that the request does not contain the channel by which to contact you, INMOBILIARIA VINTE will freely establish the method it deems pertinent to send you information about your request.

The deadline to meet your request will be 5 calendar days, when you will be informed whether or not your request will proceed.

 

X.– In all cases of applications addressed to INMOBILIARIA VINTE, a copy of official identification must be included, which may be one of the following:

  • Valid voting credentials issued by the National Electoral Institute (INE).
  • Valid passport.
  • Professional certificate issued by the Ministry of Public Education (SEP).
  • National Military Service Record issued by the Ministry of National Defense (SEDENA).
  • Current immigration document issued by the National Migration Institute; (in the case of foreigners).
  • Consular Registration Certificate issued by the Ministry of Foreign Affairs or the corresponding Consular Office.
  • Postal identity card (issued by SEPOMEX).
  • Certificate or proof of studies.
  • Proof of residence.
  • IMSS membership credential.
  • ISSSTE membership credential.

 

XI. OPTIONS AND DISCLOSURE METHODS OFFERED BY THE RESPONSIBLE PARTY TO HOLDERS IN ORDER TO LIMIT THE USE OR DISCLOSURE OF THEIR PERSONAL DATA

To prevent unauthorized access to your personal data and in order to ensure that the information is used for the purposes set out in this privacy notice, we inform you that you data is held in an internal database, the administration of which is through access codes that change periodically and for which access is restricted to authorized persons; confidentiality agreements with our staff, internal policies regarding privacy notices, among others, which prevents the alteration, use, access or improper disclosure of your personal data.

 

XII. USE OF COOKIES, WEB BEACONS OR ANY OTHER SIMILAR OR ANALOG TECHNOLOGY

INMOBILIARIA VINTE collects standard registration information on the site www.vinte.com.mx, including your IP address, browser type, language, access times and website addresses.

To ensure that this website is being well managed and to facilitate better navigation, we or our service providers may use cookies (small text files that are stored in the user’s browser) or web beacons (electronic images that count the number of visitors that have accessed a particular page and certain cookies) to collect aggregated data.

On the www.vinte.com.mx INMOBILIARIA VINTE website there are also links to other external sites, of which the content and privacy policies are not our responsibility. The personal data obtained through these technologies may be shared with Mexican or foreign third parties which support INMOBILIARIA VINTE, its subsidiaries, affiliates, co-owners and controller.

If you do not wish to use the tracking technologies, you can disable them by following the steps that your respective browser sets out in the Menu Bar, ‘Help’.

To explain in more detail, a Cookie is a data file that is stored on the user’s computer equipment or electronic communication device hard disk when browsing the internet, which allows information to be exchanged between said site and the user’s browser. XIII. VIDEO SURVEILLANCE

Any visit to our business units or sales areas, may be recorded, solely for your security and that of other visitors. The images and sounds that are captured are stored for no more than 24 hours.

The images and sounds that are captured by our video surveillance cameras can only be transmitted to any authority when the request is well founded and with due cause.

 

XIV. PROCEDURES AND MEANS FOR WHICH THE RESPONSIBLE PARTY SHALL COMMUNICATE THE CHANGES IN THE PRIVACY NOTICE TO THE HOLDERS
